ProDrop — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ProDrop website, mobile application, game, training modes, competition modes, leaderboards, route content and related services (collectively, "ProDrop" or the "Service").

In these Terms, "we", "us" and "our" refer to the legal entity identified above.

Please read these Terms carefully before using ProDrop.

By accessing or using ProDrop, you agree to these Terms to the extent permitted by applicable law.

1. ProDrop is a game

ProDrop is a video game and recreational digital product.

This is fundamental to your use of the Service.

Although ProDrop uses or may use data derived from real-world roads, mountains, cycling routes, elevation data and geographic sources, ProDrop is not a real-world navigation system, safety system, cycling instruction service or authoritative representation of actual road conditions.

ProDrop is designed primarily for entertainment and may additionally include game mechanics intended to challenge skills such as:

These game mechanics must not be interpreted as professional training, safety instruction or real-world cycling advice.

2. Not real-world cycling advice

Nothing presented in ProDrop constitutes professional advice about how you should ride a bicycle in the real world.

In particular, ProDrop does not provide authoritative advice concerning:

Never use a speed, braking point, racing line, reaction cue or other gameplay element shown in ProDrop as a basis for deciding how to ride a real bicycle.

Real-world riding decisions must always be based on the actual conditions in front of you.

3. Racing lines are indicative and fictionalised

ProDrop may display:

All such information is part of the game simulation.

These elements are indicative, simulated and approximate.

They may be generated using:

They are not guaranteed to represent the safest, fastest or otherwise appropriate real-world way to ride a particular road.

The term "ideal line", where used in the game or marketing materials, means an in-game reference line within the ProDrop simulation.

It does not mean an objectively ideal or safe real-world cycling line.

4. Real-world routes may differ substantially

ProDrop may recreate or be inspired by real-world cycling descents and roads.

However, a ProDrop route may differ from the corresponding real-world location.

Differences may include, without limitation:

Roads can also change after the underlying source data was collected.

A route appearing in ProDrop must therefore never be treated as a current or authoritative representation of that road.

5. ProDrop is not a navigation service

Do not use ProDrop for navigation.

ProDrop must not be relied upon to determine:

Use appropriate official information and navigation resources when planning real-world travel.

6. Simulated speeds are not safe-speed recommendations

ProDrop may display speeds in kilometres per hour or other units.

These values exist within the game simulation.

A speed that is achievable in ProDrop does not indicate that the same speed is achievable, appropriate or safe on the corresponding real-world road.

The game may intentionally alter or simplify:

Never attempt to reproduce an in-game speed or performance on a public road merely because it was possible in ProDrop.

7. Physics are simulated

ProDrop's physics are approximations.

Even where we attempt to use physically plausible models, the simulation cannot account for every variable involved in real-world cycling.

Actual bicycle behaviour depends on many factors, including:

ProDrop cannot reproduce all such factors.

Do not extrapolate real-world performance or safety margins from the simulation.

8. Training Mode

ProDrop may offer a feature called "Training Mode", a "Training Centre", reaction training or similar terminology.

The word training refers to game-based practice within ProDrop.

It does not mean that ProDrop is:

We may design exercises intended to challenge reaction speed, attention, memory or coordination.

We do not guarantee that these exercises will produce measurable improvements in real-world cycling ability, reaction time, cognitive performance or safety.

9. Reaction challenges

ProDrop may contain reaction challenges such as:

These are game mechanics.

They must not be interpreted as instructions to perform equivalent actions while descending a real road.

A manoeuvre that is harmless or successful in the game may be dangerous in real life.

10. Real-world cycling remains inherently risky

Cycling, particularly descending at speed, can involve serious risks.

These may include:

Using ProDrop does not make real-world cycling safe.

Completing a route, achieving a high score or ranking highly on a ProDrop leaderboard does not establish that you have the skill required to descend the corresponding road safely in real life.

11. Always follow real-world laws and conditions

When riding a bicycle in the real world, you are responsible for:

Where there is any conflict between something shown in ProDrop and actual road conditions, signs, laws or official instructions, the real-world information always takes precedence.

12. Do not use ProDrop while riding

Do not operate the ProDrop game while riding a bicycle, driving a vehicle or otherwise participating in traffic.

ProDrop is intended to be played in a safe environment on a compatible device.

Do not interact with gameplay controls, reaction exercises, leaderboards or other ProDrop features while operating a real bicycle or vehicle.

13. No guarantee of route accuracy

We may use third-party or open geographic datasets to create ProDrop routes.

Although we may make reasonable efforts to process and review this data, we do not guarantee:

Geographic source data may itself contain errors.

Our processing may introduce further simplifications or inaccuracies.

14. Changes to routes

We may update a ProDrop route at any time.

Reasons may include:

Different route versions may therefore behave differently.

Where relevant for competition, leaderboard results may be separated by route or physics version.

15. Competition and leaderboards

ProDrop may provide:

Leaderboards are provided for entertainment.

We may reject, remove or invalidate results where we reasonably believe they involve:

We may also reset or separate leaderboards when:

No leaderboard position has monetary value unless we explicitly establish a separate competition with separate rules.

16. Fair play

You must not intentionally:

17. Availability

We aim to provide a reliable Service but do not guarantee uninterrupted availability.

ProDrop may occasionally be unavailable due to:

Offline functionality may remain available where supported.

18. Development status

ProDrop may initially be provided while still under active development.

Features may:

Physics, routes, scoring, Training Mode and Competition Mode may evolve significantly.

Pre-release descriptions are not guarantees that a particular future feature will be released.

19. Purchases and additional routes

ProDrop may offer free and paid content.

For example, some routes may be available without additional payment while other routes, route packs or features may require purchase.

Purchases made through Apple's App Store or another platform are also subject to that platform's applicable terms and payment rules.

Prices and available products may change.

Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

20. Intellectual property

Unless otherwise stated, the ProDrop software, game systems, user interface, branding, original artwork, audio, text and other original content are owned by or licensed to us and are protected by applicable intellectual-property laws.

You receive a limited, personal, non-exclusive, non-transferable right to use ProDrop for its intended purpose subject to these Terms.

You may not reproduce, redistribute, sell, reverse engineer or commercially exploit protected ProDrop content except where applicable law expressly permits this.

21. Geographic and third-party data

Certain route or geographic information may originate from third-party or open-data sources.

Such data remains subject to its applicable licences and attribution requirements.

ProDrop's use of a geographic location, road, mountain or pass does not imply:

Unless explicitly stated otherwise, ProDrop is an independent product.

22. No affiliation with races, teams or athletes

References to real-world geographic locations do not imply an association with professional cycling events, race organisers, athletes or teams.

Unless expressly stated otherwise, ProDrop is not affiliated with, sponsored by or endorsed by any professional cycling race, organiser, team or athlete.

Protected names, logos and trademarks remain the property of their respective owners.

23. User-generated names and profiles

If ProDrop allows usernames, nicknames or other user-generated content, you must not use content that is:

We may moderate or remove content where reasonably necessary.

24. Account security

If accounts are introduced, you are responsible for protecting access to your account and device.

Notify us if you reasonably believe your account has been compromised.

We may suspend access where reasonably necessary to protect the user, the Service or competitive integrity.

25. Children and age requirements

ProDrop is not intended to encourage children or adults to reproduce high-speed descending behaviour on public roads.

Any applicable minimum age requirements imposed by the App Store, platform or local law must be respected.

Where parental or guardian consent is legally required, the user must obtain it.

Specific age ratings may be introduced as part of the applicable store-release process.

26. Health and physical considerations

ProDrop may involve rapid visual movement, sound, repeated interaction and simulated high-speed motion.

Some users may experience:

Stop playing if you experience discomfort.

Take appropriate breaks.

Users with relevant medical concerns should seek appropriate professional advice rather than relying on ProDrop.

27. Haptics and audio

ProDrop may use sound and device haptics to enhance gameplay.

These effects are simulated feedback only.

They do not represent reliable measurements of real-world forces, grip, collisions or bicycle behaviour.

28. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for loss or damage resulting from a user's decision to treat ProDrop gameplay, routes, simulated speeds, racing lines, braking points, reaction exercises or other game information as real-world cycling or safety advice.

In particular, you must not rely on ProDrop when making real-world decisions concerning descending speed, braking, road positioning, cornering or obstacle handling.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms affects mandatory rights available to consumers under applicable law.

29. No exclusion of mandatory consumer rights

If you are a consumer in the European Union, European Economic Area, United Kingdom or another jurisdiction providing mandatory consumer protections, you may have legal rights that cannot be excluded by contract.

These Terms do not seek to remove or restrict those rights.

Where a provision of these Terms conflicts with mandatory applicable law, the mandatory law prevails to the extent of that conflict.

30. Privacy

Your use of ProDrop is also subject to our Privacy Policy.

The Privacy Policy explains what personal information we collect, why we collect it and how it is handled.

The current Privacy Policy is available on the ProDrop website.

31. Changes to these Terms

We may update these Terms when reasonably necessary, for example because of:

The latest version will be published on the ProDrop website with an updated revision date.

Where required by applicable law, we will provide additional notice or request renewed agreement.

32. Termination and suspension

You may stop using ProDrop at any time.

We may suspend or restrict access where reasonably necessary because of:

Where applicable, we will act proportionately and in accordance with mandatory consumer law.

33. Governing law

These Terms are governed by the laws of the Netherlands, subject to any mandatory consumer protections that apply in the country where you reside.

If you are a consumer, nothing in this section deprives you of mandatory protections or rights to bring proceedings that applicable law grants you.

34. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.

The invalid provision should be interpreted or replaced as closely as legally possible to its intended purpose.

36. Essential safety reminder

ProDrop is a game.

ProDrop's routes, racing lines, braking points, speeds, cornering guidance, obstacles and reaction exercises are simulated and indicative. They are not instructions for riding a real bicycle.

Real roads and real conditions can differ substantially from the game.

Never attempt to reproduce an in-game speed, racing line, braking point or manoeuvre simply because it was possible or recommended within ProDrop.

When cycling in the real world, ride according to actual conditions, your own abilities, applicable laws and the safety of yourself and others.
